Not in Costa Rica, not in Uruguay, not in any of the handful of countries that have opened their markets to medical imports. People have been speculating about one for the better part of a decade — usually in the same breath as talk of cannabis becoming "the next coffee" or "the next wine" in global trade terms — but nobody has actually built the thing. What exists instead is three separate, unrelated projects, each grinding away at one piece of the puzzle without any coordination between them.
Costa Rica has spent years building a tax and customs shell that happens to work for cannabis manufacturers, the same way it once worked for medical device makers. The DEA, as part of its 2026 permit overhaul, has spent the past year building the plumbing that lets scheduled cannabis products cross borders in the first place. And California, through Senator Anna Caballero's SB 1326, has been drafting the legal template for how two jurisdictions would actually agree to trade cannabis once they're allowed to. None of these three efforts references the other two. That's the interesting part.
This piece is about what happens if someone eventually does stitch them together — what a genuine cannabis-specific trade zone would need structurally, which of these three threads is closest to load-bearing, and which countries have the clearest incentive to be first. The honest answer, laid out below, is less dramatic than a treaty signing and more like watching three separate rivers slowly find the same valley.
Costa Rica's Free Zone Regime: The Closest Thing We Have

Administered under guidance from PROCOMER, the country's foreign trade promotion agency, the regime grants qualifying companies exemption from income tax, waivers on import duties for equipment and raw materials, and relief from sales tax on inputs used in production. Cannabis manufacturers operating inside these zones can import cannabinoid feedstock, process and manufacture on-site, and export finished product abroad under customs procedures that are meaningfully faster than what a company outside the zone would face at a standard Costa Rican port of entry.
The catch — and it's an important one for understanding what this actually is — is that this isn't a cannabis-exclusive zone. It's a general-purpose free trade zone framework that happens to accommodate cannabis alongside medical devices, electronics assembly, and back-office services. Costa Rica didn't design this for cannabis; cannabis companies simply qualified under rules written for export manufacturing broadly. That distinction matters because it means the zone offers no cannabis-specific harmonization on testing standards, labeling, or cross-border recognition — it only offers a cheaper, faster place to manufacture.
There's real precedent for why this could still work as an industry-building tool. Costa Rica built its medical device export sector and much of its tech-manufacturing base through exactly this same playbook: tax exemption plus customs simplification, applied consistently over enough years that companies build durable supply chains around it. Medical device exports from Costa Rica now rank among the country's largest export categories, built almost entirely inside free zones. If cannabis follows a similar adoption curve, the industry could scale meaningfully over the next decade purely on the strength of Costa Rica lowering its own cost of doing business.
The limiting factor is on the other end. Product manufactured cheaply and efficiently in a Costa Rican free zone still has to clear destination-market import rules once it lands, and those rules remain fragmented across countries, slow to harmonize, and inconsistently enforced. Costa Rica has solved its half of the transaction. It has not solved, and cannot unilaterally solve, the bottleneck sitting on the destination side.
The DEA's 2026 Permit Overhaul: Rescheduling Without Open Borders

Rescheduling gets discussed as though it's a light switch — flip it and cannabis moves freely. The DEA's April 22, 2026 Final Order is a useful corrective to that assumption. The order amended 21 CFR 1312.30 to add three Schedule III non-narcotic categories to the agency's import-export permit list: FDA-approved marijuana drug products, marijuana extracts, and naturally derived Delta-9 THC. Every one of those categories now requires a permit before it can cross a US border in either direction — DEA Form 357 for imports, Form 161 for exports. Rescheduling didn't remove the permit requirement. It formalized which specific product categories need one and under what conditions.
That's the part of the rescheduling conversation that gets consistently misread. Moving a substance from Schedule I to Schedule III changes its classification and opens the door to certain research and pharmaceutical pathways, but it does not, by itself, create open borders. Schedule III substances still require import-export permitting under the Controlled Substances Act, and DEA's 2026 order made clear it intends to enforce that permitting rigorously for cannabis-derived products specifically, treating each shipment as its own permitted event rather than blanket-authorizing a category.
Some of the normalization signals showing up around this are smaller but still notable. That's a minor administrative change on its face, but it reflects the same underlying shift — federal agencies quietly building procedure around cannabis products as a permitted, trackable category rather than a contraband one.
Hemp, meanwhile, is on its own track entirely. A separate amendment on November 12, 2026 changed how THC content is measured for hemp definitional purposes, but it did not fold hemp into the Schedule III framework or bring it under the same permitting regime. Hemp and marijuana remain regulated as functionally different substances at the federal level, even as their chemistry converges.
What DEA actually built in 2026 is scaffolding — a permit infrastructure that could, in theory, support a future trade-zone concept by giving customs officials a standardized document to check against. It's friction-reducing plumbing, not free trade. Anyone plugging a future zone into the US market will need to plug it into Form 357 and Form 161, not around them.
SB 1326 and the State-to-State Trade Template

The bill would authorize California to import and export legally produced cannabis to and from other states, and — critically — it would authorize the Governor to negotiate interstate trade agreements governing exactly how that happens.
The required elements baked into those agreements read like a checklist for cross-jurisdictional commerce generally: shared public health and safety standards, seed-to-sale tracking compatible across state systems, tax collection mechanisms that satisfy both sides, and testing and labeling compliance recognized in both jurisdictions. Strip the word cannabis out of that list and you have the basic architecture of any agreement designed to let two regulatory regimes trust each other's product without re-testing or re-certifying it at the border. That's not a coincidence — it's the same architecture every mature interstate commerce agreement eventually needs.
There's real precedent for interstate compacts solving this exact category of coordination problem. The Real ID framework got all fifty states to agree to compatible identity-verification standards over roughly two decades of phased implementation. States also didn't uniformly open alcohol shipping overnight once it became legal again — they built out reciprocal shipping agreements state by state, a patchwork that took years to fill in and in some corners is still incomplete today. SB 1326 is essentially proposing the cannabis version of that alcohol-reciprocity process, drafted in advance of the moment it would actually become usable.
And that's the honest limitation: federal cannabis prohibition still blocks interstate commerce outright, regardless of what California and a partner state agree to on paper. SB 1326 cannot make interstate cannabis shipments legal by itself — federal law preempts it. What the bill actually does is pre-position California to move immediately the moment a federal trigger arrives, whether that's full descheduling, a federal enforcement policy shift, or a narrower interstate-commerce carveout specific to cannabis.
The pattern to watch for is the same one that played out with medical cannabis infrastructure feeding directly into adult-use rollouts. States that had already built dispensary licensing, testing labs, and seed-to-sale tracking for medical programs were generally the ones that stood up adult-use markets fastest once voters or legislatures authorized them, converting existing infrastructure in months where states starting from zero took years longer. SB 1326-style frameworks are the interstate-commerce equivalent: infrastructure built ahead of legal authorization, waiting for the trigger.
Canada's Export Boom Shows What Volume Looks Like

That's not a projection — it's the clearest evidence available that export volume can more than double in a single year once a licensed producer base, Health Canada export permits, and destination-country import authorizations are all stacked and functioning together.
What makes that number more instructive is what Canada didn't need to hit it: no dedicated trade zone, no special tax shell, no purpose-built cannabis customs regime. Just permits, market by market, accumulating as more countries opened import pathways and more Canadian licensed producers qualified to fill them. It's a useful counterpoint to the Costa Rica model — proof that volume can scale through permitting alone, without zone-style infrastructure, provided the certification bottleneck gets cleared.
That bottleneck is real, though, and it's the thing actually throttling growth rather than any lack of demand. Access to certain overseas markets requires GMP-equivalent certification issued by a national competent authority, and certification timelines commonly run 12 to 24 months from application to approval. That's the actual constraint slowing even willing, well-capitalized exporters like Canada's licensed producers — not demand, not permitting philosophy, but the sheer calendar time GMP certification consumes.
Meanwhile demand itself is diversifying faster than supply-side certification can keep up with it. Germany has been tightening parts of its regulatory framework on the demand side even as its patient base grows, and Brazil's medical cannabis patient population has been expanding steadily, creating a second serious demand center outside Europe entirely. Supply certification is a slow, linear process; demand is showing up in multiple markets simultaneously.
Here's where the forecasting has to be explicit about its own uncertainty: if GMP-equivalent certification timelines compress even modestly — say, through streamlined mutual-inspection agreements — or if Canada and its trading partners eventually strike something resembling the mutual-recognition agreements pharmaceutical regulators use with trusted trading partners, export volume could scale substantially further without any trade zone existing at all. That's a real possibility, not a certainty; GMP mutual recognition agreements for pharmaceuticals took years of technical negotiation to establish even between longstanding allies, and cannabis carries additional scheduling complications those products didn't. What a Purpose-Built Cannabis Trade Zone Would Actually Require

Costa Rica's zone doesn't require destination-equivalent testing. DEA's permits don't establish shared potency or contaminant standards with any trading partner. SB 1326 proposes testing compliance recognized between US states, but says nothing about international harmonization. That gap — mutual recognition of what a lab result actually means — is the missing load-bearing wall.
There's a real precedent for how that gap eventually closes, and it's worth taking seriously as a timeline reference. Mutual recognition of Good Manufacturing Practice certifications between trusted trading partners didn't happen overnight — it emerged from a multi-decade process of technical negotiation, inspection-sharing, and incremental trust-building between regulators who had years of aligned pharmaceutical standards behind them before cannabis was ever part of the conversation. Frictionless trade in a controlled product category is achievable. It's also slow.
Here's the grain of salt worth sitting with: cannabis still carries a Schedule I or Schedule III status and a cultural and political history that pharmaceuticals mostly shed decades before their GMP mutual-recognition agreements were finalized. That suggests the harmonization timeline for cannabis could run longer than the pharmaceutical analogy implies, not shorter — cannabis regulators are starting from a more contested political baseline than penicillin manufacturers ever were.
And when a zone does emerge, the beneficiaries are unlikely to be the countries with the loudest cannabis policy debates. Small, produce-and-export-oriented economies like Costa Rica or Uruguay have every incentive to formalize a dedicated zone, because their domestic markets can't absorb their production capacity and export is the whole point. Large domestic-market countries have far less urgency — their own consumption absorbs most of what gets produced, so building export infrastructure competes for regulatory attention against a domestic market that's already demanding it.
Nobody is building a cannabis trade zone on purpose. That's the throughline worth holding onto. Costa Rica is optimizing its export manufacturing base the same way it has for decades, cannabis included almost incidentally. The DEA is enforcing a scheduling change and happens to be building permit plumbing along the way. California is pre-positioning for a federal trigger that hasn't arrived. Three different actors, three different motives, and not one of them referencing the others in their own planning documents.
The realistic long-term path isn't a treaty signing or a single announcement — it's incremental convergence. Costa Rica-style free zones proliferate across other small export economies looking to replicate the medical-device playbook with cannabis. US interstate frameworks like SB 1326 stay dormant, fully drafted, until a federal trigger — descheduling, an enforcement policy shift, an interstate-commerce carveout — actually activates them, at which point states that did the paperwork early move first, the way medical-cannabis states converted to adult-use markets fastest. Certification timelines compress slowly, maybe through mutual-recognition agreements modeled on pharmaceutical precedent, maybe not for another decade.
If you're trying to spot where this actually happens first, stop watching the large markets. Countries with substantial domestic demand have less structural urgency to build export-specific infrastructure while their own markets keep absorbing supply. Watch instead for smaller countries with limited domestic cannabis demand but strong existing logistics, port infrastructure, and tax-incentive regimes already built for other export industries. Those are the places with the clearest motive to be first, because for them, a cannabis trade zone isn't a nice-to-have policy experiment. It's the same growth strategy they've already run once, applied to a new crop.
